What is an Aggravated DUI in Arizona?

In Arizona, aggravated DUI is a felony charge. It usually refers to a DUI or DWI charge committed while driving with a restricted, suspended, or revoked license. When compared to standard DUI charges, aggravated DUIs carry higher consequences, including mandatory minimum prison time.

Aggravated DUI charges can be found in Arizona Revised Statute §28-1383.

A DUI is considered aggravated when:

  • The driver is found to have suspended/revoked/restricted license.
  • The driver is found to have been issued an ignition interlock device.
  • The driver has already had two prior DUI convictions in the last seven years.
  • The driver is found to have a minor in the vehicle.
