How an injury case usually moves

Steps in a personal injury case: first call, investigation, treatment, demand, negotiation, and a lawsuit if needed
Every case is different, and timelines vary. We explain each step when you call.

Did another lawyer drop your case?

If another firm withdrew from your injury case or sent you a disengagement letter, your deadlines keep running. Here is what to do if your lawyer dropped your case.

Arizona injury claim basics

Every case is different, but a few Arizona rules shape almost every injury claim. We explain how they apply to you when you call.

  • Deadlines. In Arizona, most injury lawsuits must generally be filed within 2 years (A.R.S. § 12-542). Claims against a public entity or public employee have their own deadlines: a notice of claim is generally due within 180 days (A.R.S. § 12-821.01), and the lawsuit generally must be filed within one year (A.R.S. § 12-821). Read about the Arizona personal injury statute of limitations.
  • Shared fault. Arizona generally follows a pure comparative fault rule: if you were partly at fault, your claim is usually not barred, but your damages may be reduced by your share of fault (A.R.S. § 12-2505). See how comparative fault works in Arizona.
  • Uninsured and underinsured drivers. Auto insurers generally must offer uninsured (UM) and underinsured (UIM) motorist coverage in writing, though the policyholder can decline it (A.R.S. § 20-259.01). Read our guide to uninsured motorist claims in Arizona.
  • Right after a crash. Get medical care, get the report number, and talk to us before you give a recorded statement. See what to do after a car accident in Phoenix and how to get a Phoenix police accident report.
