You call your lawyer's office, leave a message, and wait. Days go by. Meanwhile the medical bills keep coming, the adjuster may still be calling, and you don't know where your case stands. That's a hard place to be. You have a right to know what's happening with your own injury case. If your questions aren't getting answered, you can get a second opinion. Call Kent Law at (480) 359-KENT for a free case review. We won't criticize your current lawyer, and the decision is yours.
Your right to be kept informed
You have a right to be kept reasonably informed about the status of your case, and to get prompt answers to reasonable requests for information. When a full answer can't come right away, you should still hear back that your message was received and when to expect a response.
In plain words: it's reasonable to ask where your case stands, and it's reasonable to expect an answer.
What to do if your lawyer isn't calling you back
- Put your request in writing. Send an email or letter asking for an update on your case and a time to talk. Keep a copy.
- Ask who handles your case day to day. Ask for the name of the lawyer and the staff member working on your case, and how to reach them.
- Keep an eye on your deadlines. Your deadlines keep running whether or not anyone calls you back. See the deadlines section below.
- Be careful with the insurance company. If an adjuster contacts you directly, call us before you give a recorded statement or sign anything.
- Keep getting medical care. Follow your doctor's advice and keep your records and bills.
- Get a second opinion. Call us. Bring what you have. We'll tell you honestly where things stand.
Tired of waiting for a call back?
Tell us where your case stands and what you've been told. We'll explain your options in plain words. There is no obligation.

- Jonathan Henry, our Managing Attorney, who has extensive trial experience.
- Andrew Shaver, our Supervising Attorney.

How we keep you updated
We keep you updated along the way. We explain your options at each step, and you make the key decisions, including whether to accept a settlement. When you have a question, call or text us. We deal with the insurance company, so you don't have to take their calls.
Switching lawyers: your file and your deadlines
Your file. When a lawyer stops handling your case, you have a right to your file, and the lawyer should take reasonable steps to protect your interests as the case changes hands. If you hire us, we can request the file for you.
Your deadlines. In Arizona, most injury lawsuits must generally be filed within 2 years (A.R.S. § 12-542). Claims involving a public entity or public employee, like a city bus or a government employee driving for work, have shorter deadlines. A notice of claim is generally due within 180 days (A.R.S. § 12-821.01), and the lawsuit generally must be filed within 1 year (A.R.S. § 12-821). Read more about the Arizona personal injury statute of limitations.
Your prior lawyer's fees. If your prior lawyer did work on your case, they may ask to be paid for that work out of any recovery. Whether they can, and how much, generally depends on your agreement with them and on Arizona law. Before you hire us, we look at what you signed and explain how it could affect you. With Kent Law, there is no fee unless we win, and we explain our written fee agreement before you sign it.
If your lawyer has already dropped your case or sent you a withdrawal letter, see what to do if your lawyer dropped your case.
Talk with us about your case
Most of our cases are car accident claims and other motor vehicle crashes in Phoenix and the East Valley. We also handle claims involving uninsured and underinsured drivers. When a case comes to us from another firm, we check your deadlines first, look at the insurance available, and tell you honestly whether we can help.
